Protect Your Assets
One of my biggest roles as a bankruptcy attorney is making sure that I am fully protecting all of my client’s assets. When a person files for bankruptcy their assets can be exposed to creditors. Without a bankruptcy lawyer applying a detailed exemption analysis on your assets, your assets are at risk.
Many times when a client calls me for a free consultation, I will try and first figure out whether they qualify for a chapter 7. If they do qualify, next I try and determine what assets they have and if they file for a chapter 7 can they keep all of their assets.
For most of my clients, they keep all of their assets in a chapter 7 bankruptcy: this includes their home, car, houshold goods, checking and savings accounts, 401ks and IRAs.
The laws of exemptions which allow you to protect your assets is quite complicated as it deals with rules of finance, real property law, and personal property law.
